Article 2: Definitions

  • Rasma: Rasma BIM & Engineering Studio.
  • Customer: any natural person or legal entity that enters into an agreement with Rasma.
  • Consumer: a customer who is not acting in the course of a profession or business.
  • Business customer: a customer who is acting in the course of a profession or business.
  • Digital product: a file delivered through the webshop, such as a Revit family, Revit template or family set.
  • Custom work: work that Rasma produces on request and according to the customer's wishes, such as a custom template, a custom family or drafting work.

Article 3: Applicability

  1. These terms apply to every offer made by Rasma and every agreement between Rasma and the customer.
  2. The use of digital products is also subject to the License Terms. In the event of conflict, the License Terms prevail.
  3. The customer's own general terms and conditions do not apply, unless Rasma accepts them in writing.

Article 4: Offer and agreement

  1. All prices in the webshop are in euros and include the VAT applicable to the customer. Which VAT applies depends on the customer's country and is shown at checkout:
    • consumers in the Netherlands: Dutch VAT;
    • consumers in other EU countries: the VAT of their own country (digital services);
    • business customers in other EU countries with a valid VAT identification number: VAT reverse-charged, the customer accounts for VAT in their own country;
    • customers outside the EU: no Dutch VAT; any taxes or duties in the customer's own country are for the customer's account.
    Business customers receive an invoice stating the VAT separately or stating the reverse charge.
  2. If the webshop shows prices in another currency, this is a conversion for information purposes; payment is made in euros or in the currency shown at checkout, at the exchange rate at that moment.
  3. An agreement through the webshop is concluded as soon as the customer has completed the order and has received the confirmation by e-mail.
  4. A quotation for custom work is valid for 30 days, unless the quotation states otherwise. An agreement for custom work is concluded as soon as the customer has accepted the quotation in writing or by e-mail.
  5. Obvious mistakes or errors in the offer are not binding on Rasma.
  6. The webshop is available in Dutch, English and Arabic. In the event of a discrepancy between a translation and the Dutch text of these terms, the Dutch text prevails.

Article 5: Payment

  1. Orders in the webshop are paid in advance, using the payment methods offered in the webshop.
  2. For custom work, the customer pays an advance of 20% of the quoted amount; Rasma starts after receiving the advance. The customer pays the remainder within 14 days of the invoice date of delivery.
  3. If a business customer fails to pay on time, after a reminder they owe the statutory commercial interest and reasonable collection costs. For consumers, the statutory rules on reminders and collection costs apply.

Article 6: Delivery

  1. Digital products are delivered after payment via a download link in the webshop or by e-mail. Rasma delivers digital products worldwide; no physical products are shipped.
  2. Custom work is delivered digitally, also to customers outside the Netherlands, in the manner and within the period stated in the quotation. A stated period is a target period, unless expressly agreed otherwise.
  3. The customer checks a delivery as soon as possible and reports errors within a reasonable period, preferably within 14 days.
  4. Digital products from the webshop are delivered immediately after payment; in any case within 30 days, unless agreed otherwise.
  5. Legal guarantee: a digital product must conform to the agreement and to the description in the webshop. If it does not, Rasma repairs or replaces it free of charge. If that is not possible, the consumer may terminate the agreement or ask for a price reduction, as provided by law. These statutory rights apply in addition to the free bug fixing under the License Terms.

Article 7: Cooperation of the customer

  1. For custom work, the customer provides the required data, drawings and standards in good time.
  2. The customer warrants that they have the right to provide the supplied files to Rasma and to have them edited.

Article 8: Right of withdrawal

Consumers have the right of withdrawal as described in Right of withdrawal and returns. Consumers outside the EU have the same rights, supplemented by the mandatory rules of their own country. Business customers have no right of withdrawal.

Article 9: Intellectual property

  1. All rights to digital products, templates, families, drawings and other works of Rasma remain with Rasma, unless agreed otherwise in writing.
  2. The customer only receives a right of use in accordance with the License Terms.
  3. Rasma may use custom work, without identifiable customer data, for its own products, unless agreed otherwise. Rasma shows a customer's work in a portfolio only with the customer's permission.

Article 10: Use and checking by the customer

  1. Digital products and custom work are tools for drafting and modeling. They do not replace a structural calculation or a check by a structural engineer.
  2. Supplier data (for example of formwork systems) is taken from that supplier's documentation. In the event of a discrepancy, the supplier's current documentation always applies.
  3. The customer remains responsible for checking dimensions, quantities and feasibility in their own project.

Article 11: Liability

  1. Rasma is only liable for direct damage resulting from an attributable failure.
  2. Towards business customers, liability is limited to the amount the customer paid for the product or assignment concerned. Towards business customers, Rasma is not liable for indirect damage, such as consequential damage, lost profit and delay in a construction project.
  3. These limitations do not apply in the event of intent or deliberate recklessness on the part of Rasma. Towards consumers, they apply only to the extent permitted by law.

Article 12: Complaints

Customers report complaints by e-mail to info@rasma.nl, with a clear description. Rasma confirms receipt and responds in substance as soon as possible, and within 14 days at the latest. Rasma is not affiliated with a dispute resolution body. If we cannot resolve the matter together, the consumer may go to court (see Article 13).

Article 13: Applicable law and disputes

  1. Dutch law applies to all agreements. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
  2. Consumers also retain the protection of the mandatory rules of the country in which they live.
  3. Disputes with business customers are submitted to the competent court in the district of Midden-Nederland (Central Netherlands). Consumers retain the right to go to the court of their own place of residence, insofar as the law provides.

Article 14: Changes

Rasma may change these terms. For an agreement already concluded, the version in force at the time of conclusion continues to apply.

Version: 29-10-2026 (v0.7).
